ONLINE STORE TERMS AND CONDITIONS


§1 General Provisions

The online store blackedbrick.com (hereinafter the "Store"), available at www.blackedbrick.com, conducts retail sales via the Internet on the basis of these Terms and Conditions (hereinafter the "Terms").
The Store is owned by: INDECO EDAR DARIUSZ DĄBROWSKI, conducting business under the name INDECO EDAR DARIUSZ DĄBROWSKI, ul. Drzymały 14, 89-600 Chojnice, NIP (Tax ID) 9531914513, REGON 220383657.
The address for dispatch, returns, complaints, and correspondence is: INDECO EDAR, ul. Drzymały 14, 89-600 Chojnice, Poland.

These Terms and Conditions are an integral part of the sales agreement concluded with the Client.
The conclusion of a sales agreement requires the Client’s acceptance of these Terms.
Prices listed in the Store are gross prices (including VAT).
Information about goods on the Store's website, including descriptions, technical and operational parameters, and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code.


§2 Orders

  1. The Client may make purchases in the Store either by registering a Client account or without registration.

  2. Registration is done by completing and accepting the registration form provided on one of the Store's pages.

  3. Registration requires acceptance of the Terms and Conditions and the provision of personal data marked as mandatory.

  4. For the performance of the sales agreement, both registered and non-registered Clients agree to the processing of the personal data they provide.

  5. Providing consent to the processing of personal data is voluntary but necessary for the order to be fulfilled. Failure to provide data or to consent to processing may make order fulfillment impossible.

  6. Personal data of the Store's Clients are stored by the Seller and secured in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).

  7. To place an order, the Client should:

    • visit the Store's website and select the desired product,

    • register or place an order without registration,

    • if ordering without registration – complete the order form with the recipient's details, delivery address, delivery method, and invoice details,

    • click the "Order and Pay" button,

    • select one of the available payment methods,

    • make payment within 5 business days; failure to do so will result in order cancellation.

  1. Placing an order constitutes a declaration of intent to conclude a sales agreement under these Terms.

  2. The order will be processed only if the Client provides data allowing verification of the Client and the recipient of the goods. The Store confirms receipt of the order by email or phone. The Store reserves the right to refuse an order, limit payment methods, or require prepayment if there are reasonable doubts about the accuracy of the provided data or payment method.

  3. The information on the Store’s website at the time of placing the order, including price, product description, features, set components, and delivery terms, is binding for the parties.

  4. Information on the Store's website does not constitute an offer under the Civil Code. By placing an order, the Client makes an offer to purchase the specified goods.
    Orders placed on weekends or public holidays may take longer to process.


§3 Delivery, Prices, and Payment Methods

  1. Goods are delivered to the address indicated by the Client in the order.

  2. Delivery methods available:

  • Courier

  • InPost parcel lockers

  • Personal pickup

  1. Payment methods available:

    • PayPal

    • Stripe

  2. Shipping costs are specified in the delivery price list. The delivery time is from 7 to 14 business days, starting:

  • in the case of PayU, PayPal, or Stripe payments – from the date the Seller’s bank account is credited.

§4 Complaints

  1. The Seller is obliged to deliver goods free from defects and is liable to the Client who is a consumer for physical or legal defects of the purchased goods (statutory warranty) in accordance with the Civil Code and the Consumer Rights Act. Warranty liability is excluded for Clients who are not consumers.

  2. Complaints may be submitted by email or in writing to: INDECO EDAR, ul. Drzymały 14, 89-600 Chojnice, Poland.

  3. A complaint should include the Client’s contact details, a detailed description of the defect, and the Client's demands.

  4. The defective product should be sent to the Seller’s address. The Seller will respond within 14 days from receiving the returned goods and the reason for the complaint. If expert opinion is required, this period is extended accordingly.

  5. In justified complaints, the Seller bears the cost of replacement or repair, including shipping costs.

  6. Differences in product display on the Client’s device (e.g., colors) due to individual monitor settings are not grounds for a complaint.

  7. Refunds will be made using the same payment method as the original transaction unless the Client agrees otherwise. For card payments, refunds are made directly to the Buyer’s card.


§5 Right of Withdrawal

  1. The consumer has the right to withdraw from the sales agreement within 14 days without giving any reason.

  2. The period begins when the consumer or a third party designated by them (other than the carrier) takes possession of the goods.

  3. Withdrawal may be made by sending a written or electronic declaration to the Seller: INDECO EDAR, ul. Drzymały 14, 89-600 Chojnice, Poland. Sending the declaration before the deadline is sufficient to meet the time limit.

  4. In the event of withdrawal, the agreement is considered null and void.

  5. The Seller shall promptly, no later than 14 days from receiving the withdrawal notice, refund all payments made, but not before the goods are returned by the consumer.

  6. The consumer must return the goods no later than 7 days from the withdrawal date.

  7. The consumer is liable for any diminished value of the goods resulting from use beyond what is necessary to establish their nature, characteristics, and functioning.

  8. The right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized.


§6 Personal Data Protection

  1. Personal data provided during registration or ordering is processed as necessary for account maintenance or contract performance, in accordance with the Act on Electronic Services and GDPR. The data controller is INDECO EDAR DARIUSZ DĄBROWSKI, who processes it for contract performance, legitimate business interests, or with the Client’s consent (e.g., marketing).

  2. The Store may share personal data with:

  • postal operators and courier companies,

  • legal advisors and debt collection agencies,

  • IT service providers managing Store systems,

  • marketing and advertising agencies for commissioned campaigns.

  1. Under GDPR, Clients have the right to:

  • access their data and receive a copy,

  • rectify data,

  • delete data,

  • restrict processing,

  • object to processing,

  • lodge a complaint with a supervisory authority,

  • withdraw consent at any time without affecting prior lawful processing.

  1. Providing personal data is voluntary but necessary for placing orders. Marketing-related data processing occurs only with separate consent.


§7 Intellectual Property

Any use of materials published on the Store's website (including product photos and descriptions) without written consent is prohibited.


§8 Entry into Force and Changes to the Terms

  1. The Seller reserves the right to introduce or withdraw offers, promotions, and to change product prices without affecting rights acquired by the Client, especially in relation to contracts concluded before the changes.

  2. In matters not covered by these Terms, applicable law applies, in particular the Civil Code, the Consumer Rights Act, and the Act on Electronic Services.

  3. These Terms do not exclude or limit any consumer rights under mandatory provisions of law. In case of conflict, such legal provisions take precedence.

  4. The Seller may amend these Terms for important reasons.
